(KLZA)--Dismissed with prejudice.
That's the ruling of a Nebraska court regarding a lawsuit filed by Salem Grain Company against the individuals the company says conspired in an attempt to expand Consolidated Grain and Barge in Falls City.
The lawsuit, filed in July in Richardson County District Court, sought financial damages caused by the alleged wrongful acts of the individual defendants.
However, the District Court has dismissed the lawsuit, saying that the plan for expansion did not violate Nebraska's Consumer Protection Act.
The Court's ruling means that Salem Grain Company can not amend it's complaint and refile the lawsuit. However, the company does have 30 days to appeal the Court's order.
The individuals named in the lawsuit have ties to either Falls City government, the Economic Development and Growth Enterprise organization, or both.
The lawsuit was the latest to be filed in connection with an ongoing legal battle attempting to halt the expansion project.
