More Than $1 Million Awarded In Lawsuit

(KAIR)--A monetary award of more than $1 million.

That was the decision of the Kansas Supreme Court regarding a lawsuit filed against Atchison County-based Bromley Quarry and Asphalt, Inc by landowners who claimed the quarry illegally took more than 855,000 tons of limestone from a mine on their property.

The violations took place sometime between February 1996 and March 2011.

Bromley Quarry admitted to taking around 173,000 tons of rock in the two years preceding the lawsuit, but claimed it did not owe for any rock taken before that time.

According to a press release, the Supreme Court has awarded the landowners, Willis Armstrong and Stephanie Prohaska, a monetary award of $1.7 million, and has sent the case back to Atchison County District Court for further proceedings that could increase the amount.

This case was heard by the Supreme Court at an April 12 special session held at the Hiawatha High School.
