(KAIR)--A decision regarding whether or not a sitting Atchison County Commissioner can hold two county roles simultaneously is now in the hands of the Judge.

That follows a hearing held Wednesday in an Atchison County District Court courtroom where Commissioner John Calhoon appeared in person, represented by his attorney Michael Kuckleman who has argued on Calhoon's behalf that his client's commission role and that of Jackson County Undersheriff are not a violation of the state statute cited by Atchison County Attorney Sheri Becker.

Becker, in March and following the seating of Calhoon as 2nd District Commissioner, filed the lawsuit seeking Calhoon remove himself, or be removed, from one of the two roles.

Calhoon was selected to fill the vacated commission seat during a county Republican convention in late January. He is currently seeking the Republican nod for election to the seat, challenged by Randell Vanderweide during the August 4 Republican primary.

Wednesday's hearing concluded with the court taking the matter under advisement, with court documents stating that a written decision will be issued. A timeline for the judge to do so is not stated.
