( KNZA )--An Atchison County District Court Judge has denied monetary sanctions against the family of rural Horton murder victim Patricia Kimmi, sought by the wife of the man convicted in her killing.
In his order Thursday, the Topeka Capital Journal reports Judge Robert Bednar said there was no evidence to show that a wrongful death lawsuit filed by Kimmi’s children against Rebecca Hollister was brought for an improper purpose.
She had asked the court for sanctions—including expenses and attorneys’ fees against Kimmi’s children and their attorney.
Kimmi’s children filed the lawsuit in September 2011 against Roger Hollister, Hollister’s wife, Rebecca, and their father, Eugene Kimmi.
In December of last year, Judge Bednar dismissed Rebecca Hollister from the lawsuit. She subsequently filed for sanctions to be levied against Kimmi’s children.
Roger Hollister is serving a life sentence for the November 2009 death of Patricia Kimmi.
