(KLZA) Drivers of two of three vehicles involved in an incident Wednesday, June 26th on East 14th Street in Falls City have now been cited by the Falls City Police Department.
According to the Falls City Police Department report a 2002 Chevy S-10 pickup driven by 34 year old Timothy L. Wittwer of Falls City was westbound on 14th Street about 4:35 p-m. Wittwer told the officer he met an eastbound pickup driven by 50 year old Robert D. Fisher of Falls City and that Fisher turned his 2008 Ford F-350 pickup around and started to follow him at a high rate of speed. The report says Wittwer alleges Fisher got in front of him and stopped. Wittwer said he went around the Fisher pickup continuing on west on 14th Street when he noticed Fisher begin to follow him again, then noticing another pickup, a 2006 F-250 driven by 19 year old Phillip Doerr of rural Verdon coming from the east at a high rate of speed.
Wittwer stated Doerr struck his vehicle causing it to roll.
Doerr told the Falls City Police Officer investigating the incident that he was westbound on 14th Street following Fisher. Doerr said that a welder fell out of the Fisher pickup and that he went around the welder and Fisher’s pickup and collided with the Wittwer pickup.
Doerr said his pickup veered to the right rolling onto it’s top and sliding through grass and striking a light pole and street light, ending up in the middle of Fulton Street just north of the intersection with 14th Street.
The report indicates that Fisher refused to speak with officers.
Doerr was issued a citation for willful reckless driving. Fisher has been issued a citation for willful reckless driving and having an unsafe load. Wittwer was not cited.
Wittwer was taken by ambulance to Community Medical Center with what was described as a disabling injury to his back or spine. He was later transferred to a Lincoln hospital for treatment of his injury. He has since been released from the hospital.
The investigation into this incident is ongoing.
Timothy Wittwer is currently released on bond, awaiting an August 6th jury trial in Richardson County District Court on a class I-C felony charge of using a firearm to commit a felony and a class IV felony charge of terroristic threats. The charges stem from his December, 2012 arrest for allegedly going to the home of Robert Fisher and threatening him with a pistol.
