(KLZA) -- Attorney J.L. Spray from Lincoln, representing David Leon Frederick of Falls City appeared before the City Council in Falls City Monday night. Frederick has been involved in a number of legal proceedings with the City and Falls City Economic Development and Growth Enterprise in recent years following the announcement that Consolidated Grain and Barge was planning to locate in Falls City.
The latest issue Frederick is taking on with the city is over utility rates. Spray did the speaking Monday night suggesting the city has grouped a number of customers together in the rate study unfairly.
Spray presented a list of 38 Falls City utility customers he feels should not be grouped together. The group includes 19 churches and three federal departments while leaving out the Falls City Chamber of Commerce and Falls City EDGE.
Spray made a request during a presentation that lasted less than five minutes. He called putting such a diverse group together in a classification is discriminatory, asking churches and other groups he described as non-profit, charitable organizations from the classification.
Following Sprays presentation, there was no comment and no action from the Council or Mayor Tim Hersh. Following the meeting the Mayor, City Administrator Jorn and Attorney Mike Dunn all declined to comment on Sprays presentation.
