(KLZA)-- The Nebraska Supreme Court has reviewed, and overruled, an appeal of a motion for rehearing of a lawsuit filed by David Leon Frederick of Falls City against the City of Falls City and Falls City Economic Development and Growth Enterprise.
The ruling was handed down March 11.
In January the State Supreme Court found that Falls City Economic Development and Growth Enterprise, a private economic development group in Falls City that receives most of its funding from public money is not subject to the state’s open public records law. On January 26th, Frederick filed an appeal, seeking a rehearing.
In the January ruling the Nebraska Supreme Court ruled EDGE is not the financial equivalent of an agency, branch or department of Falls City and therefore, EDGE’s records requested by Frederick are not “public records.”
The Supreme Court decision vacates and reverses the writ mandumus and order awarding attorney fees to Frederick in the amount of $17,109.59, and the cause was remanded to the District Court of Richardson County with directions to dismiss.
