(KTNC) - A lawsuit filed against former Richardson County Attorney Robert Meyer and the Weaver and Merz Law Firm has been dismissed.
District Judge Daniel Bryan granted Meyer’s motion to dismiss the complaint following a hearing on November 26.
The original complaint, filed in May, alleged that Meyer breached his fiduciary duty as the trustee of an insurance trust for Shelby, Nebraska resident Jlee Rafert. The lawsuit claimed that Rafert paid premiums totaling more than $400,000 for three life insurance policies totaling more than $8.5 million, but the premiums were not forwarded to the insurance companies, causing the policies to lapse.
Rafert and her four daughters filed the complaint, naming Meyer and the Weaver and Merz Law Firm.
Judge Bryan had dismissed the original lawsuit in September, but allowed Rafert to file a second amended complaint within 20 days. That was filed on October 10.
Judge Bryan, in a ruling filed Wednesday in Richardson County District Court, granted a motion to dismiss the second amended complaint with prejudice. That means the lawsuit cannot be filed again.
Meyer was elected Richardson County Attorney in 2010 and resigned after the complaint was filed.
