Two Found Guilty of Social Security Disability Fraud

(KLZA)  United States Attorney Deborah R. Gilg and the Office of the Inspector General/Social Security Administration announced that on Friday,  a United States District Court jury returned guilty verdicts against Timothy H. Shirley, 51, and Matthew K. Shirley, 48, following a 6 day trial.  Timothy H. Shirley was convicted of one count of Conspiracy, one count of Theft of Government Property and one count of Social Security Fraud.  Matthew K. Shirley was convicted of one count of Conspiracy and one count of Theft of Government Property.
Evidence presented at the trial showed that during the period of 2004-2010, Matthew K. Shirley managed and operated Mare, Inc., a family owned trucking company in Nebraska City.  During that period he employed his brother, Timothy H. Shirley, at the company knowing that Timothy H. Shirley was receiving social security disability insurance benefits.  As a result of their conduct, Timothy H.  Shirley received approximately $135,000 in disability benefits that he was not entitled to receive.
Sentencing has been set for October 29, 2012, before Chief Judge Laurie Smith Camp.
