( KNZA )-- A motion to withdraw his plea is denied.
That's the fate of the attempt made by a Lancaster man accused of scalding his girlfriend's two year old daughter while she bathed, leaving the child with serious burns.
Following the denial of the motion by a Doniphan County District Court judge, 25-year-old Brandon Mottin is now set to be sentenced November 7th, in Doniphan County District Court, on a charge of aggravated battery.
He pleaded no contest to the charge in August as part of a plea agreement.
The victim’s mother, 26-year-old Cassie Collins of Highland, was convicted earlier this year of aggravated endangerment of a child. She was given a suspended six-month prison sentence and placed on one year supervised probation.
However, Collins was arrested in July for a probation violation and faces a November 7th hearing.
