Plea Entered in Fairview Woman's Attempted Murder Case

( KNZA )--A Fairview woman accused of attempting to kill her 7-year-old son last April has entered into a plea agreement.

Brown County Attorney Kevin Hill says Tammy Thomas entered an Alford plea of " guilty” Friday afternoon to two felony counts contained in an amended complaint----aggravated arson and aggravated endangerment of a child.

Thomas had originally been charged with attempted first-degree murder. Authorities allege she poured gasoline on the bottom bunk of her son's bed early April 4th while he slept in the top bunk.  The gasoline wasn't ignited and no one was injured. 

A jury trial in the case had been scheduled to begin Tuesday in Brown County District Court.

Hill says Thomas faces prison when she is scheduled to be sentenced March 25th.  Based on her criminal record, Hill expects she will be sentenced to 89 months in prison on the aggravated arson charge and 5 months in prison on the charge of aggravated endangerment of child.         

Thomas was previously convicted in 1997 on a charge of aggravated battery in the 1996 slashing her then 3-year-old daughter’s throat with a knife and was sentenced to 48 months in prison.

Hill said law enforcement was consulted and were in favor of the plea agreement. Based on the court's pre-trial rulings, Hill said her prior conviction wasn't going to be admissible to the jury in the current case and the state's main non-law enforcement witness had sufficient issues pertaining to previous convictions and substance abuse that was going to be admissible to the jury.  In addition, he said the defense had subpoenaed the 7-year-old victim in the case and the plea agreement will save him from having to testify against his mother.  

Hill said the plea will also ensure a lengthy prison sentence without risk a jury may not find the requisite intent required for the original charge of attempted murder.  In addition, he said the potential sentence she's facing in the current case will be almost double what she received for actually inflicting bodily harm on her child back in 1996.
