(KAIR) -- A hearing in a wrongful death suit filed against a Missouri highway agency by the parents of a former Benedictine College basketball player was continued Monday in Platte County Circuit Court.
The hearing in the alleged wrongful death of R.J. Demps was continued until June 7th.
Demps was killed when his car slid off of Missouri Highway 45, down a steep embankment and struck a large tree that was located within the highway’s clear zone on December 21, 2011 when he was heading to Kansas City to catch a flight home to Colorado for Christmas break.
The lawsuit claims that the Missouri Highways and Transportation Commission failed to properly maintain the highway’s clear zone and failed to erect a guardrail to protect the travelling public on that dangerous section of highway which near Weston.
The 20-year-old Demps was a reserve guard on Benedictine squad after being recruited by Regis Jesuit High School in Aurora.
