Bail Denied For Convicted Murderer

(KAIR)--A convicted Atchison County murderer, whose case was overturned, will remain behind bars for the time being. 

That follows a hearing in Atchison County District Court Wednesday focused on the motion filed by the legal counsel for Kirk Wilson seeking his release on bail.  

The Atchison County Attorney's Office says the motion seeking bail was withdrawn.  However, it's not immediately clear what led to that decision, with representatives of Wilson's legal counsel unavailable to provide those details. 

Wilson was convicted of first degree murder in 2001 and sentenced to life in prison without parole for 25 years in connection with the March 2000 death of Kurt Boldridge.

In May, Atchison County District Court Judge Robert Bednar overturned the conviction on constitutional grounds, saying Wilson was denied the right to a fair trial. 

The Kansas Attorney General's Office is acting as special prosecution in the case, opposing both the motion for bail and the Judge's ruling.
