07/24/2013

(KTNC ) - A Pawnee County man convicted of stealing money from his elderly uncle will serve time in the state penitentiary.

Lewis Rakosnik of DuBois was sentenced Monday in Pawnee County District Court.

He was convicted in May on 39 counts, including 33 counts of felony abuse of a vulnerable adult, two counts of attempted abuse of a vulnerable adult, and four misdemeanor counts of attempted felony abuse.

Authorities said Rakosnik stole hundreds of thousands of dollars from his elderly uncle over an 11-month period.

During Monday’s sentencing hearing, District Judge Daniel Bryan sentenced Rakosnik to five years in the Nebraska Department of Corrections on the first charge of knowing and intentional abuse of a vulnerable adult.

He was sentenced to one year in the Pawnee County Jail on the other 38 counts.  That sentence will be served in the Nebraska Department of Corrections, concurrently with the other sentence.  He was also ordered to pay court costs amounting to $891.

Rakosnik will be eligible for parole after six months and subject to release after two-and-a-half years.  He was given credit for three days served in jail.

Judge Bryan rejected Rakosnik’s motion for a new trial and also denied a request to stay the sentence.
