A 42-year-old Atchison man has two rape charges added to four additional felony counts after testimony at his preliminary hearing.
Testimony included from the now 40-year-old female victim, the victim’s husband and her physician on Tuesday and Thursday swayed Atchison County Judge Martin Asher to give Kevin Simmons the new counts.
Simmons already faced two counts of aggravated sexual battery and two counts of aggravated burglary.
Those four counts allege that Simmons unlawfully entered the victim’s residence on September 17th and October 6th of last year and committed unlawful touching in a sexual manner by force to the woman that was eight months pregnant at the time.
Preliminary Hearing testimony revealed that Simmons was a neighbor and was friends with the victim’s husband during the time the alleged incidents occurred.
Arraignment is scheduled for June 8th.
Simmons is out on 75 thousand dollars bond.
