Change of Venue Denied in Brown Co. Attempted Murder Case

( KNZA )--A Brown County District Court Judge has denied a motion for a change of venue in the jury trial of a Fairview woman accused of attempting to kill her young son last April.

It was among several pre-trial motions filed by the court-appointed attorney for Tammy Thomas that were heard during a hearing Friday.

Thomas was among three witnesses who testified in support of the motion for a change of venue, saying she didn’t believe she could receive a fair trial in Brown County. 

Her attorney, Bill O’Keefe, also presented newspaper and radio reports of the case along with an unscientific survey conducted of Brown County residents.

In denying the request, District Judge Jim Patton said sufficient evidence hadn't been presented to show that Thomas couldn’t receive a fair trial.    

Judge Patton also denied motions to recuse County Attorney Kevin Hill as prosecutor in the case, and to suppress statements made by Thomas to law enforcment officials regarding the case. 

A jury trial in the case is set for March 5-9th.

Thomas pleaded not guilty last September to charges of attempted first-degree murder and aggravated endangerment of a child.

She is accused of attempting to kill her 7-year-old son early April 4th of last year.  Authorities allege Thomas poured gasoline on the bottom bunk of bed while he slept in the top bunk at her mother’s residence in Fairview where they were living.

The gasoline wasn’t ignited and no one was injured.

Thomas remains in the Brown County Jail on $750,000 bond.
