Falls City Council Tables Proposed Open Burning Changes

One of the agenda items for the Monday night City Council meeting in Falls City was first reading on an ordinance to amend the regulations on fire prevention and how fires are regulated. The proposal was brought up in February by Councilman Hal Sutter and advanced on a 5-3 vote to be prepared by the City Attorney.
    The proposal would reduce the time for allowed burning of trash from the current two days per week, to just one day a week, Wednesday’s between the hours of 10 a-m and 2 p-m.
    During the Mayors report, Mayor Tim Hersh explained why he did not speak about the topic in February. ( play audio :33 seconds )
    The Mayor went on to say he feels it is not right to infringe on the rights of the citizens. ( play audio :22 seconds )
    The Mayor also said there are rules in place now, and that the public needs to help make sure those rules are followed. ( play audio :16 seconds )
    Later in the meeting Councilman Sutter made a motion to table the first reading on the ordinance since there was not a full council present. Council members Jerry Oliver and Kirby Robidoux were absent Monday night. Both voted in favor of going forward with the more restrictive burning rules in February. The vote to table was 5-1 with Councilman Ryan Rieschick casting the lone nay vote. Councilmen Steve Scholl and Jim Wisdom who voted against the proposal in February voted to table the issue.
    Had the motion to table not been approved, and the Council members voted the same as in February, it would have been up to Mayor Hersh to break the tie on whether or not the proposed amendment moved forward.
    It appeared that several persons in attendance at the meeting were prepared to comment on the topic.
