Atchison Nuisance Violator’s Property Abated
11/20/2012

(KAIR) -- At 8:50 this morning, officials with the City of Atchison’s Community Development Department and the Atchison Police Department served an administrative search warrant on 915 N. 12th Street.

The warrant issued by the 1st Judicial District Court of Kansas directed officials to search for and abate items that violate the City’s Nuisance Ordinance.

City officials joined efforts today to clean up junk, debris, a boat, and a trailer at 915 N. 12th Street, at the intersection of Division and 12th Streets.

All costs of the cleanup will be charged to the owner of the property, and any fees not paid will be assessed to the property.

Items removed from the property were disposed of at the Atchison County Transfer Station.

For several months, the City and its attorney retained on this matter have been in negotiations with a lawyer representing the resident of the property.

When negotiations failed to result in complete abatement of the nuisance conditions on the property, the City decided to take action and apply with District Court for an administrative search warrant.

The search warrant allows City of Atchison officials to search for nuisances and abate them according to City Code.

The City will continue to take appropriate action as allowed through its ordinances to ensure that the property does not continue to create a blighted situation in the neighborhood.
