A 52 year old Effingham man currently jailed on child sex allegations gets a battery charge for allegedly striking the inmate that stole his property.
David Smith will make his next appearance February 10th on a class a misdemeanor charge of battery.
The charge alleges Smith struck his cellmate at the time, Christopher Price on January 14th, shortly after Price returned to jail on a warrant before his sentencing.
Price was convicted in January on several theft charges, including taking items that belonged to Smith last August.
Smith was already incarcerated on 30 sex charges, including 15 counts of rape and 15 counts of aggravated indecent liberties with a child, allegedly occurring to a 12 year old girl between September 2010 and February 2011.
He’s pled not guilty to those charges and prosecution will present their case in a jury trial on February 14th.
