Man to Again Face Trial in Attempted Murder Case

(KAIR) -- Following a mistrial, a rural Valley Falls man accused of attempted first-degree murder will again face a jury, while at the same time, charges filed against his wife are dismissed. 

The trial for John Hayworth, Junior has been set for June 11th.

Jefferson County Attorney Jason Belveal says four days have been set aside for the trial.

Meanwhile, charges for his wife, Bernadine, were dismissed Tuesday without prejudice in Jefferson County District Court with the state’s right to re-file the case within the next five years.

Bernadine Hayworth was originally charged with aggravated battery and obstructing apprehension of prosecution for her alleged role in the incident.

John Hayworth was arrested December 4th, 2011 by the Jefferson County Sheriff’s department after allegedly shooting William Schoonover of rural Valley Falls. Schoonover later recovered.

The department alleges that Hayworth fired the shot following an argument with Schoonover over cattle.

A mistrial was declared last October due to the inadvertent showing of the wrong DVD containing evidence related to the case.

Hayworth remains free on a 50 thousand dollar property bond.
