(KAIR) -- A motion for a change of venue in the jury trial for the wrongful death lawsuit filed by the children of slain rural Horton resident Patricia Kimmi has been denied.
The ruling was made Tuesday by District Judge Robert Bednar.
The motion for a change of venue was filed by the attorney for Patricia Kimmi's ex-husband, Eugene. The other two defendants in the civil suit, Roger and Rebecca Hollister, joined the motion.
Bednar cited that the defendants failed to produce any affirmative evidence that public opinion has been swayed for any potential bias of jurors in the county.
Meanwhile, a motion filed by Roger Hollister for a change of judge that was scheduled for Wednesday afternoon was postponed to October 15th.
The wrongful death suit, filed last year on behalf of Patricia Kimmi's four children, seeks more than $75,000 from each of the three defendants.
Roger Hollister is representing himself in the matter.
Hollister is currently serving life in prison for capital murder in connection with the death of Patricia Kimmi in November 2009.
A jury trial in the civil suit has been tentatively set for January 14th with pre-trial motions set for November 7th.
