(KAIR) -- The Atchison City Commissioners Monday night voted unanimously to settle a lawsuit that claims some city property is out of ADA compliance.
The federal lawsuit, filed earlier this year by Tiffany Nickel and the Kansas Disability Coalition, claims that property, including city hall, parks and the Atchison Public Library are not accessible for handicapped citizens.
Steve Pigg, who represents the city in federal cases, says the first allegation says the city didn’t complete a federally regulated transition plan.

Pigg says this is the best course for the city.

Reimbursement will be a flat fee of counsel for 45 hundred dollars, as well as two thousand 194 dollars of litigation expenses.
Pigg says there was also another condition of the settlement.

Pigg says the earliest the individual designated to conduct the self-evaluation is available to start it is early 2013.
The board also heard comments from a concerned business owner about what he says is a lack of communication between the city and county.
Derek Franklin says the funding of solid waste reforms is going to be a detriment to businesses and citizens in the county.

According to a chart distributed at the meeting by City Manager Trey Cocking, the city pays 405 thousand dollars to the county as part of the one cent sales tax.
Atchison County Commissioner Jeff Schuele addressed the comment of a lack of communication between the two bodies.

In other business, Commissioners unanimously passed a resolution for the second phase of funding to resurface U.S. 59 from the Amelia Earhart Bridge to west city limits.
They also unanimously established scrapping business license fees and amendments to the zoning and subdivision code.
It was also announced that City Hall will be closed Thursday and Friday for the Thanksgiving holiday and that Wednesday, Thursday and Friday trash will be picked-up Wednesday.
